The Death Sentence of Political Prisoner Hossein Kheiri was reversed by the Supreme Court.
The human rights center of “No to Prison- No to Execution”, Tuesday, November 16, 2021- The death sentence of political prisoner Hossein Kheiri, who was previously sentenced to death by Branch 26 of Tehran Revolutionary Court on the charge of “Moharebeh by destroying public property”, was void by the efforts of a team of lawyers at the Supreme Court.
Babak Paknia, the lawyer, tweeted: “Hossein Kheiri’s death sentence issued by Branch 26 of Tehran Revolutionary Court was void by the Supreme Court after appealing.”
In July 2021, Dr. Paknia announced that a death sentence has been issued for this political prisoner on charge of “Moharebeh”. He also stated that if the defense was carefully audited and considered, the sentence would be reversed.
At the same time, Dr. Paknia had stated: “An indictment was issued by the Security Prosecutor’s Office (Evin) against eight individuals, in which four were declared as “Mohareb” (enemy of God) and the rest were wanted persons under the charge of assembly and collusion against national security and so on. The reason for the charge of “Moharebeh” of these individuals was the destruction of people’s property with the intention of confronting the system.”
Regarding the case of four defendants accused of “Moharebeh”, Babak Paknia stated: “In this case, we defended, and the court accepted that of those four, three could not be punished under the title of “Moharebeh”. The title of “Moharebeh” and the charges were removed. These people were really among the weak of the society. In the meantime, the actions of Hossein Kheiri, the other defendant in this case, have been found to be an example of “Moharebeh”; death sentence was issued for him.”
The lawyer had stated that “given the strong evidence we have, it indicates that the title of “Moharebeh” cannot be adapted to the actions taken. In addition, there are many defects in the case, and therefore I believe that the Supreme Court will void the vote if it carefully considers our bill and the flaws raised.”
Hossein Kheiri, 33, is originally from Noorabad, Lorestan provinc. He grew up in Kermanshah and resided there. He was arrested by Ministry of Intelligence forces in Tehran in July 2020 and transferred to Evin Prison.
